Our terms and conditions comply with UK legislation and are designed to ensure that our customers can shop easily and with confidence at www.baybeds.co.uk By accessing this website and/or placing an order you agree to be bound by these conditions set out below. Please read the conditions carefully as they affect your rights and liabilities under the law. If you do not agree to be bound by the conditions you may not use or access this website.


These terms and conditions only apply to web site sales.




Accepting orders and security

When you place an order, either by telephone, email or through our website, we will treat it as an offer to buy. If we accept your order, we will send you a confirmation email with your order number, at which point we make a legal contract with you. However, we will be entitled to refuse to accept your order if we feel it necessary, in which case we will email you as soon as we can to let you know.

When you receive your email confirmation, please take the opportunity to check the details and let us know within 24 hours of any errors to the order.

In deciding whether to accept your order we may use the information you have given to us, or we already hold about you, or which we receive from any enquiry we may make with various agencies to confirm your identity. This assists us to protect you and us from fraudulent transactions. If we decline your offer on security grounds we may contact you to seek an alternative payment method. For security reasons, we may restrict the volumes of items to be sold in any one transaction.



All prices are shown in GBP and are inclusive of VAT at the prevailing rate. Prices may be subject to change without notice.



You may pay using any major credit or debit card. We also accept payments via PayPal which can be selected when proceeding through to check out.

Product availability

Items shown on this website may not always be in stock. An estimated delivery time is displayed next to each individual product. Please note that this date is an estimate only, may be subject to change without notice and does not constitute a contractual obligation by The Bay Bed Company Ltd to supply goods by a certain date. However, should availability be unduly delayed we will use our best endeavours to keep you informed.

Once your order is ready for despatch we will contact you to arrange a convenient delivery slot.

We offer free delivery to the following post code areas:

LA1, LA2, LA3, LA4, LA5, LA6, LA7, LA8, LA9, LA10, LA11, LA12, PR1, PR2, PR3, PR4, PR5, PR6, PR7, FY1, FY2, FY3, FY4, FY5, FY6, FY7, FY8.

Unfortunately, we do not currently deliver to anywhere outside of these areas.

We use our own vans and in-house deliveries teams; each delivery is a two-man service.

We will deliver your items to the room of your choice, assemble the goods and take away any associated packaging.

If you have requested our free removal service this will take place simultaneously with the delivery of your new mattress and is on a like-for-like basis only. Please contact us should you require any further information or clarification info@baybeds.co.uk

We reserve the right to refuse to collect and/or dispose of any soiled or unsanitary mattress.

It is your responsibility to ensure there is adequate access to your premises for us to provide delivery of the goods ordered and that the goods ordered will freely pass through into the room of your choice. If you are in any doubt please contact us prior to placing your order.

If our delivery staff consider the means of access is unsafe we will not deliver the goods until you provide us with safe access. We will not be responsible for any additional costs, other than normal transport costs, in effecting a delivery including (without limitation) the removal of doors and windows to gain access. You are obliged to provide us with any required parking permits in advance and shall indemnify us for any parking costs or parking fines incurred whilst unloading your goods at the delivery address.

If we are invited to place the goods in position in the delivery address we will do so as a invitee of you. Save where damage results from our negligence or our employees’ negligence we will not be liable for any damage to your property or that of third parties or of any premises occurring in the course of our delivery of the goods to you. All goods must be inspected on delivery by you (or an adult representing you) and you (or an adult representing you) shall sign a delivery note to confirm the delivery and inspection of the goods. We may treat a refusal to sign a delivery note as a refusal to take delivery of the goods being delivered.

We may deliver the goods by separate instalments and we will notify you on delivery of the first instalment if delivery by a second or further instalment is required.

If you are unable, for whatever reason to take delivery of the goods on the agreed delivery date including but not limited to where the means of access is unsafe, we reserve the right to charge you an additional delivery charge for each subsequent delivery which is payable in advance of any further attempts by us to deliver your order.



We will store your goods free of charge for a maximum of 28 days from the later of the goods being available or from our first attempt at delivery, thereafter we reserve the right to charge you a storage fee on a daily basis.




Cancellations and returns

We want you to be 100% satisfied with any product you purchase from us at The Bay Bed Company Ltd. Under Consumer Regulations you have the right to cancel your order as long as you do so no later than 14 days after the day on which you receive the goods. If you would like to return an item to us you may do so within 14 days of receiving it. You have the right to cancel the contract within 14 days without giving a reason with the exception of shop soiled ex-display models and specially made orders such as custom sizes. Your right to cancel is void if the purchased product has been removed from its original packaging.

To exercise this right to cancel, you must inform us The Bay Bed Company Ltd, 35-37 Queen Street, Morecambe LA4 5EQ of your decision to cancel this contract by a clear statement in writing either by letter or email ( info@baybeds.co.uk).

Effects of cancellation – If you cancel this contract, we will reimburse to you all payments received from you. We will make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay and not later than – (a) 14 days after the day we receive back from you any goods supplied, or (b) if earlier, 14 days after the day you provide evidence that you have returned the goods, or (c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods. For goods which by their nature cannot be returned by post the cost is estimated at a maximum of approximately £100.

Goods which cannot be sent by post include mattresses and divans.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

If you requested to begin the performance of services during the cancellation period, you shall pay us an amount which is in proportion to what has been performed until you have communicated us your cancellation from this contract, in comparison with the full coverage of the contract.


Cancellation of orders for bespoke goods or special order goods by you

“Bespoke goods” means non-standard goods manufactured to a specification provided by you to us.

“Special order goods” means goods which are commissioned specifically for you from the manufacturer.

We will only accept notice of cancellations of orders for Bespoke goods or Special order goods if the order can be cancelled with our supplier without incurring a fee, if a fee is payable to our supplier to cancel the order any deposit paid by you will not be refunded. If we are able to cancel the order with our supplier without incurring a fee we will refund the deposit paid by you for the Bespoke goods in full within 14 days of receipt of the notice of cancellation. We do not accept cancellations for Bespoke goods at any time from (the earlier of either) 7 days from the date of the confirmation of your order or once we have confirmed the Bespoke goods are available for delivery. Please note Bespoke goods or Special order goods cannot be returned to us, this does not affect your rights under the Warranty for faults.


Transit damage

All goods are examined in detail by ourselves prior to despatch to ensure that they leave our warehouse in perfect condition. However, transit damage unfortunately can occur. If your purchase is showing obvious signs of transit damage upon delivery, please refuse to accept delivery and notify us immediately. If damage is only evident upon opening of packaging, then you must inform us within 24 hours of receipt. In either case, we will then arrange re-delivery of replacement goods as soon as possible.


Faulty goods

Goods are fully guaranteed against faults in manufacture, materials or workmanship for a minimum period of 12 months from delivery, dependent on the manufacturer.

If your goods develop a fault within 28 days of delivery, the goods may be returned for either refund in full, or replacement. Replacement only is offered after 28 days and before the end of the guarantee period. We will replace the goods with the same model or, if no longer available, substitute with an equivalent specification mattress or the same value towards the purchase of a new mattress.

Any mattress which develops a fault due to being used on a damaged base or where bed slats are greater than 75mm apart, will not be covered by the manufacturer’s guarantee. Turning and rotating of the mattress must be carried out as per the care instructions.

Any evidence of misuse, mistreatment, customer abuse or failing to maintain as per the care guide, will void the manufacturer’s guarantee.

No warranty is made in respect of commercial rather than domestic use.

Please note surface fillings of mattresses may flatten; this is called dipping or settlement and is normal with use.

The firmness/tension rating of mattresses is subjective and is offered as an indication; it is intended for general guidance only.

Sales on this website are governed by English law and you agree to submit any dispute to the non-exclusive jurisdiction of the English courts. All orders are subject to these terms and conditions and no amendments will be accepted by us. These terms and conditions do not affect your legal rights.

These terms and conditions only cover the website www.baybeds.co.uk. Any other web site to which you link from this site may be governed by their own terms and conditions. We accept no responsibility or liability for the content of websites which are not under our control.

We are required by law to tell you that sales can be concluded in English only and that we do not file copies of customer contracts. baybeds.co.uk is a trading name of The Bay Bed Company Limited.

We do not guarantee that this website will be compatible with all customers’ computers.
